Settlements have to be agreed to by all the party’s involved. It has to be when you want a settlement, the insurance company wants a settlement, the employer wants a settlement and everyone is on the same page and wants a settlement. If you are the only one who wants a settlement, it is often not going to happen. The factors that determine the workers' compensation settlement and the amount of the settlement depends on how much your case will cost the insurance company throughout your life if it is not settled. Every case is different, some of the factors include how old you are, how much are your weekly benefits (which are dependent on how much you were earning when you were hurt), and how long do you expect to be disabled.
